At LockAssure, your privacy is important to us. We collect only the information necessary to provide our services, such as your name, email, and company details when you book a demo, create an account, or contact us. We use this information to communicate with you about your demo, orders, and product updates.
You can opt out of non-essential emails at any time using the unsubscribe link provided in our messages or by contacting us at hey@lockassure.com.
All information provided to LockAssure in connection with your use of the Licensed Software is subject to our Privacy Policy. Please review this policy before using the Licensed Software.
US Government Users
The Licensed Software is classified as a “commercial item” and is provided to U.S. Government end users as a commercial end item with the same rights as other customers.
Disclaimers
The device is not certified as a door lock and must be used with a certified lock in good condition. LockAssure does not monitor emergency notifications and is not a third-party monitored emergency notification system. Do not use the device, licensed software, or application for emergency or life-saving purposes.
Disclaimer of Warranties
To the maximum extent permitted by law, the licensed software is provided “as-is” without warranties. LockAssure disclaims all warranties relating to the licensed software, including merchantability, fitness for a particular purpose, and non-infringement. If required by law, any warranties are limited to ninety (90) days from the date of download or purchase.
Limitation of Remedies and Damages
LockAssure is not liable for indirect, incidental, consequential, special, or punitive damages, or any loss of data, use, or profits. LockAssure’s aggregate liability shall not exceed the greater of the amount paid for the device or US$150.
Limitations on Claims
Any claim or cause of action arising from this Agreement or the Licensed Software must be filed within one (1) year from the date such claim or cause of action arose.
Indemnification
You agree to indemnify and hold LockAssure and its affiliates, suppliers, and vendors harmless from any claims arising from your use or misuse of your Account, Device, Licensed Software, Application, or Service.
Term and Termination
This Agreement is effective upon your acceptance and continues until terminated by you or LockAssure. LockAssure may terminate this Agreement upon five (5) days’ notice for any breach. Upon termination, you must stop using the Licensed Software and the Device.
Compliance with Laws
You agree to comply with all applicable export and trade laws and regulations. The Licensed Software, Device, and related technical data are subject to U.S. Export Administration Regulations.
Amendments and Modifications
LockAssure may modify this Agreement from time to time. Material revisions will be notified to you, and continued use of the Licensed Software after such revisions indicates your acceptance.
Confidential Information
You must protect the confidentiality of LockAssure’s Confidential Information and use it only as permitted under this Agreement. Confidential Information includes the Licensed Software and any information characterized as confidential.
Assignment
You may not assign this Agreement without LockAssure’s prior written consent.
Waiver
Any waiver by LockAssure must be in writing. Failure to enforce any provision of this Agreement on one occasion does not constitute a waiver of any other provision or of such provision on any other occasion.
Severability
If any provision of this Agreement is found contrary to law, the remaining provisions will continue in full force and effect.
Governing Law and Venue
This Agreement is governed by the laws of the State of Arizona and the United States. Any legal action must be brought in the state or federal courts located in Maricopa County, except that LockAssure may seek relief in any court of competent jurisdiction to protect its intellectual property and proprietary rights.
Dispute Resolution; Mandatory Arbitration
Any disputes arising out of or relating to this Agreement or your use of the Licensed Software and Device shall be determined exclusively by final and binding arbitration under the American Arbitration Association’s (AAA’s) Commercial Arbitrati
